These Terms & Conditions (the “Terms”) govern your access to and use of the website healthcovermatch.com (the “Site”) and the services offered through it (the “Services”), operated by Lashia LLC, doing business as Health Cover Match (“Health Cover Match”, “we”, “us” or “our”). By accessing the Site or submitting a quote request, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old and a resident of the United States to use the Services. By using the Site you represent that you meet these requirements and that all information you provide is accurate, current and complete.
2. Description of the Services
Health Cover Match is a free health insurance comparison and referral service. We collect the information you submit and connect you with licensed insurance agents, insurance agencies, insurance carriers and marketing partners (collectively, “partners”) who may offer health insurance products in your area. Submitting a quote request is free and creates no obligation to purchase any product.
We are not an insurance company, agent or broker. We do not sell, underwrite or issue insurance, and we do not make coverage decisions. Any quote, plan, price or coverage information is provided by our partners, not by us. Invitations for applications for insurance are made only where licensed and appointed. Plans may not be available in all states, and availability, benefits and premiums vary by state, carrier and individual circumstances.
No government affiliation. The Site is privately owned and is not affiliated with, endorsed by or connected to the U.S. government, the federal Medicare program, the Health Insurance Marketplace (healthcare.gov) or any state agency. The telephone numbers and email addresses on the Site belong to Health Cover Match and cannot be used to contact any government agency.
3. No Professional Advice
The content of the Site is provided for general informational purposes only and does not constitute insurance, financial, legal, medical or tax advice. You should consult a licensed professional before making decisions about insurance coverage. We do not guarantee that any plan discussed on the Site is suitable for you.
4. Quote Requests and Consent to Be Contacted
By submitting a quote request and checking the consent box, you provide your express written consent for Health Cover Match and our partners to contact you at the telephone number and email address you provided, including through automatic telephone dialing systems, artificial or prerecorded voice messages and text messages (SMS), regarding health insurance products and related services. This consent applies even if your number is on a Do Not Call list. Consent is not a condition of purchase, and message and data rates may apply. You may withdraw your consent at any time as described in our Privacy Policy. A description of the partners who may contact you is available on our Marketing Partners page.
You agree that the information you submit may be shared with our partners as described in our Privacy Policy, and that we may be compensated by partners for these referrals.
5. Acceptable Use
You agree not to: (a) submit false, misleading or third-party information without authorization; (b) use the Site for any unlawful purpose; (c) use bots, scrapers or other automated means to access the Site or submit forms; (d) interfere with the security or operation of the Site; (e) copy, reproduce or distribute any part of the Site without our written permission; or (f) attempt to gain unauthorized access to any systems or data.
6. Intellectual Property
The Site and its content, including text, graphics, logos, images, design and software, are owned by or licensed to Lashia LLC and are protected by copyright, trademark and other laws. Carrier names and logos displayed on the Site are trademarks of their respective owners and are shown for identification purposes only; no endorsement or affiliation is implied. You may view and print pages of the Site for your personal, non-commercial use only.
7. Third-Party Websites and Partners
The Site may contain links to third-party websites, and our partners operate independently of us. We do not control and are not responsible for the content, products, services, privacy practices or conduct of any third party, including any insurance products offered by our partners. Any dealings between you and a partner are solely between you and that partner.
8. Disclaimer of Warranties
The Site and the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure, that defects will be corrected, or that any quote, rate or coverage information is accurate or available to you.
9. Limitation of Liability
To the fullest extent permitted by law, Lashia LLC and its members, officers, employees, agents and partners shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data or goodwill, arising out of or relating to your use of the Site or the Services, any communication from a partner, or any insurance product, even if advised of the possibility of such damages. In no event shall our total liability to you exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify, defend and hold harmless Lashia LLC and its members, officers, employees and agents from any claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
11. Dispute Resolution
You agree to first contact us and attempt to resolve any dispute informally for at least thirty days before initiating any formal proceeding. Any dispute that cannot be resolved informally shall be brought in the state or federal courts having jurisdiction over Lashia LLC, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you agree that any proceeding will be conducted on an individual basis and not as a class, consolidated or representative action.
12. Governing Law
These Terms are governed by the laws of the United States and of the state in which Lashia LLC is organized, without regard to conflict-of-law principles.
13. Changes to the Site and These Terms
We may modify or discontinue the Site or the Services at any time. We may also revise these Terms; the “Last updated” date at the top of this page shows when they were last changed. Your continued use of the Site after revised Terms are posted constitutes your acceptance of the revised Terms.
14. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site.
